Il presente documento contiene le Condizioni Generali di Contratto che regolano l’acquisto dei soggiorni effettuato a distanza tramite rete telematica e quindi il contratto che viene concluso con gli utenti del sito di Ges Tur Italy srl Unipersonale. In ogni caso, l’utilizzo del sistema di prenotazione on line contenuto nel detto sito comporta l’accettazione e comunque l’applicazione delle presenti condizioni generali. Ges Tur Italy srl Unipersonale si riserva il diritto di modificare senza preavviso le medesime Condizioni.
Con l’utilizzo del servizio di prenotazione on line e con l’invio telematico dell’ordine d’acquisto, il Cliente accetta incondizionatamente e si obbliga ad osservare le presenti Condizioni Generali, dichiarando di avere preso visione ed accettato tutte le indicazioni ivi contenute ai sensi delle norme sopra richiamate e prendendo altresì atto che Ges Tur Italy srl Unipersonale non sarà vincolata a condizioni diverse se non preventivamente concordate per iscritto. L’eventuale nullità o invalidità integrale o parziale di uno o più articoli delle presenti Condizioni Generali non inficia in alcun modo la validità degli altri articoli contenuti nel contratto, i quali sono da considerarsi validi ed efficaci.
a. L’inoltro della richiesta di prenotazione implica la completa conoscenza delle medesime Condizioni e la loro integrale accettazione. b. Il Cliente si impegna ed obbliga, una volta conclusa la procedura d’acquisto on line, a stampare e conservare le presenti Condizioni, già visionate ed accettate durante il processo di prenotazione, al fine di soddisfare integralmente la condizione di cui agli artt. 52 e 53 del D. Lgs n. 206/2005. c. Per acquistare i servizi di soggiorno di Ges Tur Italy srl Unipersonale è necessario avere almeno 18 anni o essere maggiorenni secondo le leggi del Paese di cui si possiede la cittadinanza. Però eventuali prenotazioni regolarmente portate a termine, ancorché effettuate da minorenni, interdetti o inabilitati, saranno comunque pienamente valide ed efficaci.
Sul sito di Ges Tur Italy srl Unipersonale sono descritte le diverse sistemazioni di volta in volta disponibili con il relativo trattamento, le relative tariffe e le relative condizioni particolari (tra cui quella relative agli acconti, ai pagamenti, alla cancellazione della prenotazione ecc.). Tali tariffe sono comprensive di IVA (tranne che nei casi di aumento della relativa aliquota, casi in cui il Cliente è tenuto a versare la relativa differenza) ma non comprendono eventuali tasse dovute in base a normative locali, quali la tassa di soggiorno italiana, che devono essere pagate direttamente in Hotel. b. Il Cliente sceglierà tra le diverse sistemazioni disponibili quella di suo gradimento secondo la relativa tariffa e le relative condizioni particolari indicate in sede di prenotazione, che vengono accettate al momento dell’inoltro dell’ordine di acquisto. Prima dell’inoltro di tale ordine e quindi prima di confermare la richiesta di prenotazione, al Cliente verrà riepilogato il costo totale dei servizi richiesti; il Cliente è tenuto a controllare tale riepilogo prima di procedere al pagamento (se previsto dalla tariffa scelta) o di rilasciare i dati della carta di credito in garanzia. A seconda della tariffa scelta dal Cliente, nell’effettuazione dell’ordine di acquisto verrà chiesto al medesimo Cliente di scegliere la modalità di pagamento (tra cui Bonifico bancario, Carta di credito, ecc.) o di inserire gli estremi di una carta di credito a garanzia dell’esatto adempimento delle obbligazioni a suo carico Dopo aver inviato il detto ordine di acquisto (o, secondo quanto previsto dalla tariffa prescelta, dopo aver effettuato il pagamento dell’importo indicato nel riepilogo servizi o di una caparra/acconto, o dopo aver inserito gli estremi della carta di credito a garanzia) il Cliente riceverà un messaggio di posta elettronica all’indirizzo dal medesimo indicato contenente il riepilogo del proprio ordine, il numero di prenotazione, le specifiche del servizio prenotato e le condizioni di cancellazione del medesimo.
Il contratto si perfeziona con l’accettazione dell’ordine di acquisto/prenotazione da parte di Ges Tur Italy srl Unipersonale. A seconda della diversa tariffa prescelta, soltanto al buon fine del pagamento previsto o della carta di credito indicata quale garanzia la prenotazione risulterà definitivamente confermata da parte della medesima Ges Tur Italy srl Unipersonale. In mancanza di tale buon fine, il Cliente non può vantare alcuna pretesa.
L’art. 47 del D. Lgs. 6 Settembre 2005 n. 206 c.d. “Codice del Consumo” esclude espressamente l’applicabilità della disciplina dei contratti conclusi fuori dai locali commerciali, dei contratti a distanza e del relativo diritto di recesso ai contratti che rientrano nell’ambito di applicazione della disciplina concernente i viaggi, le vacanze ed i circuiti “tutto compreso.
Nelle condizioni particolari relative al tipo di sistemazione/ tariffa prescelta – condizioni consultabili prima dell’acquisto sul sito Ges Tur Italy srl Unipersonale – sono indicate anche le eventuali penali che verranno applicate in caso di cancellazione/annullamento della prenotazione da parte del Cliente, In caso di partenza anticipata Ges Tur Italy srl Unipersonale ha diritto al pagamento dell’intero periodo prenotato.
Eventuali rimborsi dovuti al Cliente sono effettuati con il medesimo mezzo di pagamento utilizzato dal Cliente stesso per l’acquisto del servizio.
Le camere sono disponibili dalle ore 14,00 del giorno di arrivo e devono essere rilasciate entro le ore 11,00 del giorno di partenza. L’eventuale sistemazione anticipata o il rilascio della camera successivo rispetto ai detti orari sono soggetti al pagamento di un supplemento in loco. Il Cliente che ha prenotato la sistemazione in mezza pensione ha diritto alla prima colazione e alla cena. Per il Cliente in pensione completa il trattamento inizia di norma con la cena del primo giorno e termina con il pranzo dell’ultimo giorno. Non è possibile ottenere riduzioni per i pasti compresi e non fruiti per qualsiasi ragione.
Le richieste particolari o preferenze eventualmente segnalate dal Cliente in relazione alle camere (come ad esempio: camera vicine, al piano terra, con letti matrimoniali, ecc.) non sono vincolanti per Ges Tur Italy srl Unipersonale che sarà libera di accoglierle o meno.
Il Cliente, la cui prenotazione sia stata regolarmente confermata da Ges Tur Italy srl Unipersonale e poi pagata secondo quanto previsto dalla tariffa prescelta, ha diritto di usufruire regolarmente dei servizi prenotati anche se nell’osservanza del regolamento della struttura ricettiva.
Il Cliente è tenuto, entro la partenza, a pagare tutti i corrispettivi dovuti, anche quelli aggiuntivi, connessi a servizi/prestazioni extra di cui ha usufruito il medesimo Cliente e/o le persone che lo accompagnavano, oltre la tassa di soggiorno se prevista; la carta di credito indicata a garanzia al momento della prenotazione può essere utilizzata da Ges Tur Italy srl Unipersonale per il pagamento di tutti i corrispettivi dovutile, ivi compresi quelli aggiuntivi. Il Cliente è altresì responsabile per qualsiasi danno patito da Ges Tur Italy srl Unipersonale o da terzi, ivi compresi gli altri Clienti, da lui causato o causato da persone per le quali lo stesso è responsabile.
Se il Cliente rifiuta di saldare i corrispettivi dovuti, anche per i servizi aggiuntivi acquistati in loco, Ges Tur Italy srl, Unipersonale oltre a poter utilizzare la carta di credito indicata a garanzia in sede di prenotazione, in base all’art. 2760 c.c. avrà anche il diritto di ritenzione e di pegno sulle cose del cliente che si trovano in albergo.
L’hotel è tenuto a fornire le prestazioni e i servizi prenotati e confermati in maniera corrispondente al proprio standard. L’hotel può mettere a disposizione del Cliente una sistemazione sostitutiva adeguata (di pari qualità), a titolo esemplificativo e non esaustivo, in caso di camera inagibile, in caso di prolungamento della permanenza dei precedenti occupanti la stanza in questione, in caso di overbooking ed in tutte le ipotesi in cui le esigenze dell’hotel impongono una simile sostituzione. Eventuali costi aggiuntivi connessi alla sistemazione sostitutiva sono a carico dell’hotel.
Ges Tur Italy srl Unipersonale è responsabile dei danni patiti dal Cliente solo se il danno si è verificato nei locali della struttura e la stessa o i propri dipendenti ne siano responsabili. Se e in quanto non riesca a dimostrare che il danno non è stato causato dalla medesima Ges Tur Italy srl Unipersonale, dai suoi dipendenti o da persone che frequentano la struttura, Ges Tur Italy srl Unipersonale risponde per cose introdotte nei locali dal Cliente sino ad un importo massimo equivalente a cento volte il prezzo giornaliero pagato, anche in ipotesi di deterioramento, distruzione o sottrazione di cose, oggetti di valore, denaro e titoli di credito Ges Tur Italy srl Unipersonale non è tuttavia responsabile quando i danni o la sottrazione si siano verificati per fatto del cliente, per forza maggiore o per la natura della cosa. La custodia di oggetti può essere rifiutata nel caso in cui siano pericolosi (cioè potenzialmente in grado di provocare danni), troppo ingombranti o di valore eccessivo. Le cose si considerano introdotte nella struttura nel momento in cui sono prese in consegna da un membro del personale dell’esercizio ricettivo o siano portate in un posto, all’interno dell’esercizio ricettivo, destinato alla custodia delle stesse. Il Cliente deve denunciare il fatto senza ingiustificato ritardo alla direzione della struttura per non perdere il diritto al risarcimento (art. 1785 ter c.c.).
Ges Tur Italy srl Unipersonale si riserva il diritto di apportare modifiche ed effettuare manutenzione anche straordinaria alle strutture, anche durante il periodo di apertura al pubblico. Nel quadro delle necessarie attività di manutenzione il Cliente acconsentirà, senza per questo poter pretendere rimborsi e/o indennizzi, a che vengano eseguiti lavori nelle camere o nelle altre parti della struttura ricettiva durante la propria permanenza presso la stessa.
Gli Animali sono ammessi all’interno della struttura ricettiva.
Il Cliente non può pretendere il prolungamento del soggiorno, che deve sempre essere previamente richiesto e poi espressamente accettato da Ges Tur Italy srl Unipersonale. Qualora il Cliente non possa lasciare l’Hotel alla data prevista a causa di circostanze eccezionali e straordinarie ed imprevedibili (per es. in caso di calamità naturali, alluvioni, scioperi ecc.) e gli sono oggettivamente precluse tutte le possibilità di mettersi in viaggio, il soggiorno verrà automaticamente prorogato per tutta la durata dell’impedimento, anche presso altra sistemazione indicata da Ges Tur Italy srl Unipersonale. Quest’ultima è autorizzata in tali casi a richiedere come corrispettivo almeno il prezzo applicato in bassa stagione.
Ges Tur Italy srl Unipersonale può risolvere il contratto con effetto immediato nel caso in cui i Cliente: utilizzi i locali con grave pregiudizio della proprietà o renda intollerabile la convivenza con gli altri ospiti tenendo un comportamento prepotente, maleducato, privo di riguardo, scandaloso o in ogni caso sconsiderato o si renda colpevole di azioni od omissioni nei confronti del personale di Ges Tur Italy srl Unipersonale, degli altri ospiti e/o delle persone che si trovano nell’hotel, punite dalla legge come reato nel caso in cui sia affetto da malattia contagiosa o da malattia il cui decorso superi il periodo di soggiorno concordato o nel caso in cui si rendano necessarie cure particolari. Se il godimento del soggiorno non fosse possibile per eventi di forza maggiore (per es. calamità naturale, sciopero, serrata, ordine delle Autorità, ecc.), Ges Tur Italy srl Unipersonale può risolvere il contratto in qualunque momento senza alcun preavviso e senza che il Cliente possa vantare richieste di danni e/o indennizzi.
Qualora il Cliente non sia soddisfatto dei servizi erogati, il relativo reclamo deve necessariamente essere comunicato senza ritardo sul posto e direttamente alla Direzione della struttura.
I presenti termini e condizioni, così come i rapporti tra il Cliente e Ges Tur Italy srl Unipersonale sono comunque disciplinati dalla Legge Italiana. Per ogni e qualsiasi controversia che dovesse insorgere tra il Cliente ed Ges Tur Italy srl sarà esclusivamente competente il Foro di Brescia, con esclusione di qualsiasi altro foro eventualmente competente. “Comunicazione obbligatoria ai sensi dell’articolo 17 della legge n. 38/2006 – La legge italiana punisce con la reclusione i reati concernenti la prostituzione e la pornografia minorile, anche se commessi all’estero”.

By using the online booking service and by electronically submitting the purchase order, the Customer unconditionally accepts and undertakes to observe these General Conditions, declaring to have read and accepted all the information contained therein pursuant to the aforementioned regulations, and also acknowledging that Ges Tur Italy srl Unipersonale will not be bound by different conditions unless previously agreed upon in writing. Any nullity or total or partial invalidity of one or more articles of these General Conditions does not in any way affect the validity of the other articles contained in the contract, which are to be considered valid and effective.
a. Submitting the booking request implies complete knowledge of these Conditions and their full acceptance. b. The Customer undertakes and is obliged, once the online purchase procedure is completed, to print and keep these Conditions, already viewed and accepted during the booking process, in order to fully satisfy the condition referred to in Articles 52 and 53 of Legislative Decree no. 206/2005. c. To purchase accommodation services from Ges Tur Italy srl Unipersonale, you must be at least 18 years old or be of legal age according to the laws of your country of citizenship. However, any bookings duly completed, even if made by minors, interdicted persons, or disqualified persons, will still be fully valid and effective.
On the Ges Tur Italy srl Unipersonale website, the various accommodations available from time to time are described, along with their respective meal plans, rates, and special conditions (including those relating to deposits, payments, booking cancellations, etc.). These rates include VAT (except in cases of an increase in the relevant rate, in which case the Customer is required to pay the difference) but do not include any taxes due according to local regulations, such as the Italian tourist tax, which must be paid directly at the hotel. b. The Customer will choose from the various available accommodations according to their preference, considering the respective rate and special conditions indicated at the time of booking, which are accepted upon submission of the purchase order. Before submitting this order and therefore before confirming the booking request, the Customer will be shown a summary of the total cost of the requested services; the Customer is required to check this summary before proceeding with payment (if required by the chosen rate) or providing credit card details as a guarantee. Depending on the rate chosen by the Customer, when placing the purchase order, the Customer will be asked to choose the payment method (including bank transfer, credit card, etc.) or to enter credit card details as a guarantee for the exact fulfillment of their obligations. After submitting the said purchase order (or, as provided by the chosen rate, after making payment of the amount indicated in the service summary or a deposit/advance, or after entering credit card details as a guarantee), the Customer will receive an email at the address provided by them containing a summary of their order, the booking number, the specifics of the booked service, and the cancellation conditions.
The contract is finalized with the acceptance of the purchase/booking order by Ges Tur Italy srl Unipersonale. Depending on the different rate chosen, the booking will be definitively confirmed by Ges Tur Italy srl Unipersonale only upon successful completion of the required payment or the credit card indicated as a guarantee. In the absence of such successful completion, the Customer cannot make any claim.
Article 47 of Legislative Decree no. 206 of 6 September 2005, known as the “Consumer Code,” expressly excludes the applicability of the regulations on contracts concluded outside business premises, distance contracts, and the related right of withdrawal to contracts falling within the scope of regulations concerning travel, holidays, and “all-inclusive” packages.
The special conditions relating to the type of accommodation/rate chosen – conditions that can be consulted before purchase on the Ges Tur Italy srl Unipersonale website – also indicate any penalties that will be applied in case of cancellation of the booking by the Customer. In case of early departure, Ges Tur Italy srl Unipersonale is entitled to payment for the entire booked period.
Any refunds due to the Customer are made using the same payment method used by the Customer for the purchase of the service.
Rooms are available from 2:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. Any earlier check-in or later check-out than these times is subject to an additional charge payable locally. A Customer who has booked half-board accommodation is entitled to breakfast and dinner. For a Customer on a full-board plan, the meal plan usually starts with dinner on the first day and ends with lunch on the last day. No reductions can be obtained for meals included but not taken for any reason.
Any special requests or preferences indicated by the Customer regarding the rooms (such as: nearby rooms, ground floor, with double beds, etc.) are not binding for Ges Tur Italy srl Unipersonale, which will be free to accommodate them or not.
The Customer, whose booking has been duly confirmed by Ges Tur Italy srl Unipersonale and then paid according to the chosen rate, has the right to regularly use the booked services, subject to the regulations of the accommodation facility.
The Customer is obliged, before departure, to pay all due fees, including additional ones, related to extra services/performances used by the Customer and/or accompanying persons, in addition to the tourist tax if applicable; the credit card provided as a guarantee at the time of booking may be used by Ges Tur Italy srl Unipersonale for the payment of all due fees, including additional ones. The Customer is also responsible for any damage suffered by Ges Tur Italy srl Unipersonale or third parties, including other Customers, caused by them or by persons for whom they are responsible.
If the Customer refuses to pay the due fees, including for additional services purchased on site, Ges Tur Italy srl Unipersonale, in addition to being able to use the credit card indicated as a guarantee at the time of booking, will also have the right of retention and lien on the customer’s belongings located in the hotel, in accordance with Article 2760 of the Civil Code.
The hotel is obliged to provide the booked and confirmed services and amenities in accordance with its standard. The hotel may provide the Customer with suitable alternative accommodation (of equivalent quality), for example but not limited to, in case of an unusable room, in case of an extension of the stay of previous occupants of the room in question, in case of overbooking, and in all cases where the needs of the hotel require such a substitution. Any additional costs associated with the alternative accommodation are borne by the hotel.
Ges Tur Italy srl Unipersonale is responsible for damages suffered by the Customer only if the damage occurred on the premises of the facility and the facility itself or its employees are responsible. If and insofar as it cannot prove that the damage was not caused by Ges Tur Italy srl Unipersonale itself, its employees, or persons frequenting the facility, Ges Tur Italy srl Unipersonale is liable for items brought into the premises by the Customer up to a maximum amount equivalent to one hundred times the daily price paid, also in cases of deterioration, destruction, or theft of items, valuables, money, and negotiable instruments. However, Ges Tur Italy srl Unipersonale is not liable when the damage or theft occurred due to the Customer’s fault, force majeure, or the nature of the item. The safekeeping of objects may be refused if they are dangerous (i.e., potentially capable of causing harm), too bulky, or of excessive value. Items are considered to have been brought into the facility when they are taken into custody by a member of the accommodation staff or are brought to a place within the accommodation facility designated for their safekeeping. The Customer must report the incident without undue delay to the facility management in order not to lose the right to compensation (Article 1785 ter of the Civil Code).
Ges Tur Italy srl Unipersonale reserves the right to make modifications and carry out maintenance, including extraordinary maintenance, to the facilities, even during the period of public opening. Within the framework of necessary maintenance activities, the Customer will consent, without thereby being able to claim refunds and/or indemnities, to works being carried out in the rooms or other parts of the accommodation facility during their stay.
Animals are allowed inside the accommodation facility.
The Customer cannot demand an extension of the stay, which must always be requested in advance and then expressly accepted by Ges Tur Italy srl Unipersonale. If the Customer cannot leave the Hotel on the scheduled date due to exceptional, extraordinary, and unforeseeable circumstances (e.g., in case of natural disasters, floods, strikes, etc.) and all possibilities of travel are objectively precluded to them, the stay will be automatically extended for the entire duration of the impediment, even at another accommodation indicated by Ges Tur Italy srl Unipersonale. The latter is authorized in such cases to request at least the price applied in low season as consideration.
Ges Tur Italy srl Unipersonale may terminate the contract with immediate effect if the Customer: uses the premises with serious prejudice to property or makes cohabitation with other guests intolerable by behaving in an overbearing, rude, inconsiderate, scandalous, or in any case reckless manner, or is guilty of actions or omissions towards the staff of Ges Tur Italy srl Unipersonale, other guests, and/or persons in the hotel, punishable by law as a crime; or if they are affected by a contagious disease or a disease whose course exceeds the agreed period of stay, or if special care becomes necessary. If the enjoyment of the stay is not possible due to events of force majeure (e.g., natural disaster, strike, lockout, order of Authorities, etc.), Ges Tur Italy srl Unipersonale may terminate the contract at any time without prior notice and without the Customer being able to claim damages and/or indemnities.
If the Customer is not satisfied with the services provided, the relevant complaint must necessarily be communicated without delay on site and directly to the Management of the facility.
These terms and conditions, as well as the relationships between the Customer and Ges Tur Italy srl Unipersonale, are in any case governed by Italian Law. For any and all disputes that may arise between the Customer and Ges Tur Italy srl, the Court of Brescia shall have exclusive jurisdiction, to the exclusion of any other potentially competent court.
“Mandatory communication pursuant to Article 17 of Law no. 38/2006 – Italian law punishes with imprisonment crimes concerning prostitution and child pornography, even if committed abroad.”

These rates include VAT (except in cases of an increase in the relevant rate, in which case the Customer is required to pay the difference) but do not include any taxes due according to local regulations, such as the Italian tourist tax, which must be paid directly at the hotel. b. The Customer will choose from the various available accommodations according to their preference, considering the respective rate and special conditions indicated at the time of booking, which are accepted upon submission of the purchase order. Before submitting this order and therefore before confirming the booking request, the Customer will be shown a summary of the total cost of the requested services; the Customer is required to check this summary before proceeding with payment (if required by the chosen rate) or providing credit card details as a guarantee. Depending on the rate chosen by the Customer, when placing the purchase order, the Customer will be asked to choose the payment method (including bank transfer, credit card, etc.) or to enter credit card details as a guarantee for the exact fulfillment of their obligations. After submitting the said purchase order (or, as provided by the chosen rate, after making payment of the amount indicated in the service summary or a deposit/advance, or after entering credit card details as a guarantee), the Customer will receive an email at the address provided by them containing a summary of their order, the booking number, the specifics of the booked service, and the cancellation conditions.
The contract is finalized with the acceptance of the purchase/booking order by Ges Tur Italy srl Unipersonale. Depending on the different rate chosen, the booking will be definitively confirmed by Ges Tur Italy srl Unipersonale only upon successful completion of the required payment or the credit card indicated as a guarantee. In the absence of such successful completion, the Customer cannot make any claim.
Article 47 of Legislative Decree no. 206 of 6 September 2005, known as the “Consumer Code,” expressly excludes the applicability of the regulations on contracts concluded outside business premises, distance contracts, and the related right of withdrawal to contracts falling within the scope of regulations concerning travel, holidays, and “all-inclusive” packages.
The special conditions relating to the type of accommodation/rate chosen – conditions that can be consulted before purchase on the Ges Tur Italy srl Unipersonale website – also indicate any penalties that will be applied in case of cancellation of the booking by the Customer. In case of early departure, Ges Tur Italy srl Unipersonale is entitled to payment for the entire booked period.
Any refunds due to the Customer are made using the same payment method used by the Customer for the purchase of the service.
Rooms are available from 2:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure. Any earlier check-in or later check-out than these times is subject to an additional charge payable locally. A Customer who has booked half-board accommodation is entitled to breakfast and dinner. For a Customer on a full-board plan, the meal plan usually starts with dinner on the first day and ends with lunch on the last day. No reductions can be obtained for meals included but not taken for any reason.
Any special requests or preferences indicated by the Customer regarding the rooms (such as: nearby rooms, ground floor, with double beds, etc.) are not binding for Ges Tur Italy srl Unipersonale, which will be free to accommodate them or not.
The Customer, whose booking has been duly confirmed by Ges Tur Italy srl Unipersonale and then paid according to the chosen rate, has the right to regularly use the booked services, subject to the regulations of the accommodation facility.
The Customer is obliged, before departure, to pay all due fees, including additional ones, related to extra services/performances used by the Customer and/or accompanying persons, in addition to the tourist tax if applicable; the credit card provided as a guarantee at the time of booking may be used by Ges Tur Italy srl Unipersonale for the payment of all due fees, including additional ones. The Customer is also responsible for any damage suffered by Ges Tur Italy srl Unipersonale or third parties, including other Customers, caused by them or by persons for whom they are responsible.
If the Customer refuses to pay the due fees, including for additional services purchased on site, Ges Tur Italy srl Unipersonale, in addition to being able to use the credit card indicated as a guarantee at the time of booking, will also have the right of retention and lien on the customer’s belongings located in the hotel, in accordance with Article 2760 of the Civil Code.
The hotel is obliged to provide the booked and confirmed services and amenities in accordance with its standard. The hotel may provide the Customer with suitable alternative accommodation (of equivalent quality), for example but not limited to, in case of an unusable room, in case of an extension of the stay of previous occupants of the room in question, in case of overbooking, and in all cases where the needs of the hotel require such a substitution. Any additional costs associated with the alternative accommodation are borne by the hotel.
Ges Tur Italy srl Unipersonale is responsible for damages suffered by the Customer only if the damage occurred on the premises of the facility and the facility itself or its employees are responsible. If and insofar as it cannot prove that the damage was not caused by Ges Tur Italy srl Unipersonale itself, its employees, or persons frequenting the facility, Ges Tur Italy srl Unipersonale is liable for items brought into the premises by the Customer up to a maximum amount equivalent to one hundred times the daily price paid, also in cases of deterioration, destruction, or theft of items, valuables, money, and negotiable instruments. However, Ges Tur Italy srl Unipersonale is not liable when the damage or theft occurred due to the Customer’s fault, force majeure, or the nature of the item. The safekeeping of objects may be refused if they are dangerous (i.e., potentially capable of causing harm), too bulky, or of excessive value. Items are considered to have been brought into the facility when they are taken into custody by a member of the accommodation staff or are brought to a place within the accommodation facility designated for their safekeeping. The Customer must report the incident without undue delay to the facility management in order not to lose the right to compensation (Article 1785 ter of the Civil Code).
Ges Tur Italy srl Unipersonale reserves the right to make modifications and carry out maintenance, including extraordinary maintenance, to the facilities, even during the period of public opening. Within the framework of necessary maintenance activities, the Customer will consent, without thereby being able to claim refunds and/or indemnities, to works being carried out in the rooms or other parts of the accommodation facility during their stay.
Animals are allowed inside the accommodation facility.
The Customer cannot demand an extension of the stay, which must always be requested in advance and then expressly accepted by Ges Tur Italy srl Unipersonale. If the Customer cannot leave the Hotel on the scheduled date due to exceptional, extraordinary, and unforeseeable circumstances (e.g., in case of natural disasters, floods, strikes, etc.) and all possibilities of travel are objectively precluded to them, the stay will be automatically extended for the entire duration of the impediment, even at another accommodation indicated by Ges Tur Italy srl Unipersonale. The latter is authorized in such cases to request at least the price applied in low season as consideration.
Ges Tur Italy srl Unipersonale may terminate the contract with immediate effect if the Customer: uses the premises with serious prejudice to property or makes cohabitation with other guests intolerable by behaving in an overbearing, rude, inconsiderate, scandalous, or in any case reckless manner, or is guilty of actions or omissions towards the staff of Ges Tur Italy srl Unipersonale, other guests, and/or persons in the hotel, punishable by law as a crime; or if they are affected by a contagious disease or a disease whose course exceeds the agreed period of stay, or if special care becomes necessary. If the enjoyment of the stay is not possible due to events of force majeure (e.g., natural disaster, strike, lockout, order of Authorities, etc.), Ges Tur Italy srl Unipersonale may terminate the contract at any time without prior notice and without the Customer being able to claim damages and/or indemnities.
If the Customer is not satisfied with the services provided, the relevant complaint must necessarily be communicated without delay on site and directly to the Management of the facility.
These terms and conditions, as well as the relationships between the Customer and Ges Tur Italy srl Unipersonale, are in any case governed by Italian Law. For any and all disputes that may arise between the Customer and Ges Tur Italy srl, the Court of Brescia shall have exclusive jurisdiction, to the exclusion of any other potentially competent court.
